Join the protest against Marriage Laws Amendment Bill, 2010

Come down to the ground, get your family – parents, siblings, friends, cousins, colleagues to attend the protest against property grabbing laws and show your solidarity. Date 26 May 2012, Venue : Town Hall, Near Corporation Circle, Bangalore,. Time 9:30 AM.

Highlights of the law:

This law recognizes “Irretrievable Breakdown of Marriage” as a ground for divorce.
While the law empowers the wife to oppose the divorce at any point of time if the husband has filed for divorce, it restrains the husband from doing so when the wife has filed for the same.
This law also contains a clause by which courts will be empowered to snatch away half the property of husband and give it away to wife.
This law only talks about women’s rights and has no considerations whatsoever for men.

However, the objections raised by men’s rights organizations have been conveniently ignored by the standing committee panel, that has gone ahead and recommended the very clauses to the Govt. of India for the bill to be tabled, to which the men’s rights organizations has raised objections against.

What will happen if?

  1. Husband purchases a property just 6 months after marriage out of his hard-earned savings earned before marriage and his marriage breaks and he loses half of the property. In that case the husband will be doomed.
  2. Men start fearing this law and stop buying real estate which adversely affects the economy of the country.
  3. Husband has dependent parents and owns a single property and if 50% of that goes to wife post-divorce, how will the husband take care of his old parents? Is the concept of family restricted to only husband-wife in the Indian context?
  4. What, if the family is a Hindu Undivided Family (HUF) owning a single joint property? Will the wife get 50% of that? What about other sibling’s share in it?

SCRAP this amendment.

  1. Marriages and Divorces should not be made a property-transfer-bureau.
  2. If property division is to be done then wife’s share in her ancestral property must also be considered and then division must be done.
  3. Duration of marriage must be a crucial factor of consideration. The difference between a 2 month marriage and a 20 year marriage must be clearly understood.
  4. Property division must take into account contributions made by both the spouses and also the fact that the property was acquired from wealth earned post marriage and not from previous savings.
  5. Any and all outstanding financial liabilities on the property like loan for property, loan against property, mortgage etc. must also be equally divided and wife must be made to be equally paid for it. If she is not working then she should get her share from her ancestral property.
  6. Both the partners should have equal and unbridled right to oppose divorce and there should be no gender-bias in this.
  7. There should not be any power wrested with the courts to decide upon property transfer or stalling of proceedings as the Indian judiciary is highly incompetent and has not shown positive trends favoring men when it comes to disposing cases. The Indian judiciary is highly anti-male and does not consider twice before ordering a man to either “sell his kidney” or “beg, borrow or steal” just to pay maintenance to his estranged wife. What is the guarantee that the same judiciary will make judicious decisions when it comes to this law?
  8. Institute a National Commission for Men, that can systematically collect issues, concerns and problems of men, study them and recommend to the Govt. about measures to be taken to address those problems.

  1. WHERE R THE CONSTITUTION MAKERS? THEY R IGNORING ARTICLE 14 – RIGHT TO EQUALITY. THIS SHOULD GIVE EVERY PERSON TO DEFEND HIMSELF IN THE COURT AS PER LAW. THIS BILL IS SNATCHING THE RIGHT TO OPPOSE DIVORCE AS WELL AS GIVES UNLIMITED RIGHTS TO WOMEN. THIS IS TOTALLY ILLEGAL, UNJUSTIFIED AS WELL AS UNCONSTITUTIONAL.
    INDIAN JUDICIARY IS TOTALLY AGAINST THE HUSBANDS…….SHAMEFUL THING!!!!!

  2. I strongly protest the Marriage laws Amendment Bill, 2010 in its present form. The law in its present form will only enable greedy educated urban women to squeeze wealth from their husbands. A woman enjoys equal rights in a Job interview with men, enjoys equal rights in education, enjoys equal rights in every area of life. Then why women are given extra privielege in matrimonial matters . Such law will empower women to treat marriage as a money making tool. Women have many weapons in their armoury to torment and torture their husbands to say a few section 125, 498A ( where ailing parents are not spared ) , domestic violence and not this law.

    I pray to the law makers of the nation please refrain from making such which will spell dooms day for men . Every family will be scared when they get their son married . Definitely irretrievable breakdown of marriage is a conclusive ground for divorce , but such right to get divorced should be with both spouse. Please bear in mind husbands are not ATM machines. Already the specie husband has suffered a lot of bruises in the hands of woman NOW please spare him.

  4. Soon a Life Insurance policy will come open to only newly married men to cover risks of facing a divorce petition from the wife and parting with his hard earned wealth.

  5. Best… Keep a mistress! That too in another flat where she pays you rent officialy (100 rs a month) and you pay her in cash every month for her physical and emotional services. Say you are fuck buddies / neighbours as even live in relationships are recognised in case she goes to court…

I strongly protest the Marriage laws Amendment Bill, 2010 in its present form.I don’t understand who is making this type of foolish bills/laws, they only do this type of amendments for collecting votes from womens but they skip about the futre of there sons or other male realatives and my opinion is this type of persons are not able for get this type of high level seats. once side they said men & womens are same and the other side they only help the womens. what a foolish thinking. they thought husbands are ATM machines and use it as he wants. they suffered a lot of bruises in the hands of woman NOW please spare him.   8. I am not against making rights in a marriagle equal, but this bill totally gives all rights to women and none to men.

    Some suggestions:

    1) Only property/wealth/assets acquired post marriage should be divided equally. That too the women’s assets should also be taken into consideration. This bill does not take women’s property into consideration and it impounds on men’s assets acquired even before marriage. Its totally unfair. What if the wife divorces on the 2nd night itself saying the groom is “cruel” to her.

    2) Both parties should be allowed right to contest divorce as under the constitution both the sexes are equal. Adultery should be a criminal offense for both the parties.

    3) A registered pre-nuptial should be allowed. Let the government take 2% stamp duty on immovable the assets declared in the same. Let courts recognise it.

    About me: I am an extremely wealthy young man (in my 30’s) whose made a small fortune in a very young age. I am single right now, I don’t want to lose half my money to a golddigger woman who may divorce me in a week saying I am cruel to her, etc. I have worked years for this fortune, I won’t allow anyone to take it. Better to keep a mistress. The Supreme Court even recognises the status of a mistress as in one of it’s judgements it said: that if a man keeps a woman as a mistress or keep and pays for her expenses even if they have lived together for years he need not maintain her once they have split. Well that sounds better.
