Does it sound like a self-contradictory statement when I say, “No Money in Alimony”? Because, everyone knows that alimony is the money that a husband pays when he gets divorced from his wife, so when we say, “No Money in Alimony”, what exactly does it mean?

It simply means, “Abolish Alimony”. And do we have the eyebrows already raised?

Well, yes, then I guess this article is pretty much needed. I have often experimented by talking to people asking them, “Is it OK to abolish alimony?”

And the answer has been a majority NO, even from many of those men who are themselves paying alimony/maintenance.

And when I asked them as to why would they support alimony, the answer was, “I know my wife doesn’t deserve alimony, but there are many genuine women who should get?”

And this made me ponder and wonder, “Is it OK to burden a husband with the financial burden of his ex-wife even when the relationship is over?”

“Is it not the responsibility of the parents of the wife to make her self-sufficient rather than making her dependent on the husband?”

“Why should marriage be looked upon as avenue to generate lifestyle sustenance for women at the cost of men?”

Keeping these points in mind, I feel it’s time we abolish the concept of alimony and build social structures which take care of both men and women in old age rather than burdening a single individual with this responsibility.

And when we are abolishing the concept of alimony itself, the upcoming Marriage Laws (Amendment) Bill also needs to be scrapped in its current form because it talks of usurpation of at least 50% of the property owned by a husband in the event of a divorce. Such monetization of divorce at the cost of men is a social crime we must refrain from committing.

Having similar thoughts, men’s rights organization Save Indian Family Foundation has made a clarion call of “No Money in Alimony” and organized a peaceful protest march asking the Indian Govt. to repeal the Marriage Laws (Amendment) Bill.

Event Details,

Peaceful Protest March from Townhall to Freedom Park in Bangalore on the 18th of May 2013, Saturday from 10:30 AM onwards.

If you too feel that alimony must be abolished and men’s property must be safeguarded, do join the march and display your solidarity.

From:
Coordinator, Save Indian Family Foundation

Bangalore

To,

Dr. Manmohan Singh

Honorable Prime Minister of India

Subject: SIFF Demands Exclusive Litigation Clause to be introduced in Marriage Laws (Amendment) Bill

Respected Sir,

Save Indian Family Foundation (SIFF) is a non-profit non-funded NGO creating awareness about men’s problems and concerns and sensitizing the society about men’s rights. SIFF takes pride in its expertise in providing guidance and coaching to men facing crisis situation in their marriages, especially in extravagant situations like men facing false cases of dowry harassment (498A), Domestic Violence Act, maintenance cases etc.

Brief Background:

We have been following up the ongoing debate in the media and Govt. circles about an upcoming law, Marriage Laws (Amendment) Bill, 2010 which seeks to introduce a new ground for divorce in the Hindu Marriage Act, 1955 and Special Marriage Act, 1957 – The Irretrievable Breakdown of Marriage Ground providing for a quick no-fault divorce after three years of separation.

Dangerous Ramifications of the proposed bill:

What looks as a convenient way to dispose of the ongoing marital disputes in the country, which is seeing a splurge in divorce cases being filed, contains a few very dangerous provisions whose ramifications can be far-reaching and taxing for the society. Research conducted by SIFF leads it to believe, at the onset, that this bill is anti-male in nature and seeks to promulgate state sponsored financial extortion targeted against husbands.

This proposed bill is unconstitutional in nature as it does not respect Articles 14, 20, 21 and 22 of the Indian Constitution when it comes to married men. Married men are being offered a very raw deal in the bill as their constitutional rights of equality before law and a fair and free trial are being thoroughly jeopardized.

This bill seeks to usurp at least 50% of the property owned by the husband at the time of divorce.

This bill also stands to deny husbands the chance to oppose a petition of divorce filed by wife under this law, whereas an equivalent power wrests with the wife.

This bill does not guarantee unlimited access of a man towards his children.

This bill does not provide even a semblance of immunity to a man from other legal provisions surrounding marriage i.e. it does not bar a wife from filing a case of cruelty against the husband under section 498A / Domestic Violence against the husband while she seeks to obtain a decree of no-fault divorce.

This bill can literally render a man bankrupt as he will first be extorted by the police under a false case of 498A IPC, then the wife will file a case under the Domestic Violence Act and seek maintenance, custody of children and right to residence, then again she can still go ahead and file a case under Section 125 CrPC to seek additional no-fault maintenance and after all this she will still be guaranteed ownership of at least 50% of husband’s property or an amount equivalent to it.

The extremely anti-male nature of the Indian judiciary puts the Indian men at a position far precarious than one’s imagination as the judges, who are highly insensitive towards men, will first give away at least 50% of the husband’s property to wife and then slap additional maintenance, alimony and child support burdens onto the husband.

In such a case a man will go bankrupt honoring court orders and paying litigation fees and he will lose his property as well.

SIFF predicts that such a treatment accorded to men in marriages, for no fault of theirs, and such victimization of men may lead to rise in crime in the society.

SIFF’s Stand on the law:

SIFF completely opposes this bill in its current form as it feels this bill is thoroughly poised against men and is poisoned with a social mindset that validates burdening a man with the financial responsibility of the woman even when the marriage is over.

SIFF also despises the notion that seeks to make the wife 50% owner in the hard-earned property of a man without evaluating her contributions towards the building of the property. SIFF seeks intervention from the Honorable Prime Minister of India Dr. Manmohan Singh in passing this law before consulting SIFF.

SIFF’s demands for the Bill at hand:

SIFF seeks the introduction of the Principle of Exclusive Litigation into the law as stated below:

No such wife shall be entitled to seek divorce under the newly proposed ground of Irretrievable Breakdown of Marriage once she invokes any of the fault sections pertaining to marriage like initiating a case against husband and/or his family under any of the section of the IPC especially section 498A, 406, 506, 323, 307, 34, 120B, the Domestic Violence Act, the Dowry Prohibition Act, Section 125 CrPC, Divorce on the grounds of cruelty etc.

No such husband shall also be entitled to seek divorce under the newly proposed ground of Irretrievable Breakdown of Marriage if he has already initiated a case under divorce for cruelty against his wife.

Once a couple enters into litigation under the newly proposed ground of Irretrievable Breakdown of Marriage, they shall mandatorily enter into an MOU providing immunity to each other against further litigation i.e. they cannot file any other case against each other under either any of the matrimonial laws or any other section/act, etc. except for child custody related cases, if children are involved and the couple fail to reach a consensus of custody/visitation of children under the no-fault divorce.

SIFF feels that the above clauses are extremely necessary and important to be considered and included in the bill otherwise the problem of multifarious litigations revolving around matrimonial disputes shall not be solved and while the wife will walk away from the marriage taking divorce and 50% of the husband’s property, the man will keep on fighting other cases which is grave injustice towards husbands and cannot be allowed to be codified as a law.

In a country where we are talking of Gender Neutrality and progressive laws, SIFF is saddened by the fact that today we are at the brink of passing an extremely regressive law which, under the guise of “Financial Security to a Woman”, seeks to jeopardize the “Social Security of a Man” and one which does not cater to the social security of a man.

SIFF feels that social security which comprises of financial security as well, cannot be burdened to a single individual, rather it’s the responsibility of the society to provide measures of social security to its men and women in their old age. And burdening a man with a broken relationship is a grave crime against humanity and must be condemned thoroughly.

Hence, in wake of the above points, SIFF feels that until and unless the above mentioned Clauses of Exclusive Litigation are not made to be a part of the bill, any discussion about division of property is a direct attack on the social security of a man and such a discourse cannot continue.

SIFF is also peeved at the societal inaction for creating a male friendly society. Hence SIFF also demands that,

National Commission for Men be instituted that can conduct surveys and studies to unearth the problems faced by men and provide recommendations to the Govt. for male welfare.

Men Welfare Ministry be instituted that can implement the recommendations.

Clause of Exclusive Litigation as explained above should be introduced into the draft for Marriage Laws (Amendment) Bill.

Disclaimer: This article is not meant to justify crime or criminals, rather the article intends to understand the root cause and crux of crime in the society.

Lack of awareness of men’s rights, men’s issues, problems and an understanding of men’s rights is the biggest problem facing the men’s rights movement currently. The crux of the movement for men’s rights lies around eradication of male hatred from social mindset. Our existing social mindset judges men way too much. It loads men with expectations and gives very little acceptance to them as is reflected in the following statement:

“There is no limit to expectations from a man and there is no acceptance of the limitations of a man”

Such a mindset is precarious to the peaceful existence of men and forces the male world to be a violent one. Worst irony happens when the same men are held responsible for violence forgetting the fact that our social constructs have accorded the violent role of a Protector and that of a Bodyguard to a man. Should we want to stop violence, we must not accord the Violent Protector Role to men.

However, ongoing social trends suggest otherwise. Everywhere we see the glorification of the violent protector role of a man be it the Gillette’s ad “Soldier For Women” or ICICI Bank’s ad “Bande acche hain”.

And in this violent protector role, basically the man must fight other men. This requirement makes men insensitive to other men and the pain faced by other men. It directly attacks the male bonding in the society and makes every man cautious of every other man.

This argument, however, does not extend to women because women are not supposed to be protectors. So, even when a woman commits a crime, more often than not we see the judiciary pardoning the woman or letting her off with a minor punishment and the most ironical fact is that this behavior is acceptable to the society and such pardoning of female criminals never becomes an issue of national outrage or any kind of protest.

Even, when a man commits suicide due to false allegations, it does not move the society and the misandry (male hatred) in the society is so high that even the death of an innocent man fails to sensitize the society. There is no hue and cry in the society for getting justice to the man and punish the abusive woman who drove him to death and barring a few groups who have taken it upon themselves to fight for distressed and victimized men (ref. Save Indian Family movement), by and large the society does not feel the need to even take out a candle march for the deceased man.

These and many such incidents in the society clearly points towards a fact that society is so harsh on men. And this trend is dangerous. It perpetrates crime in the society and leads to social chaos. Men find it very difficult to communicate their problems and get support because societal misandry has not allowed the creation of any male friendly communicational spaces which allows men to communicate freely. As a result most men feel frustrated and suffocated emotionally and bottle up their emotions, feelings, pains and agonies.

Often when men are expected to take huge risks (personal, physical, financial) and are uncomfortable about taking them, they are written off as weak disposable assets and are belittled, humiliated and ridiculed. Such a socially accepted behavior gives rise to feelings of frustration and being neglected in men. This is the root cause of emergence of criminal behavior as a man feels cornered, abused and finding no way of reprieve, wants to get back at the system as a desperate attempt to bring forth the fact of how he was wronged.

But, as the misandrous system has already declared every man as criminal, any such attempt is also viewed as a crime and the system goes on promoting anti-male provisions by punishing and blaming men and fails to notice that the root cause of crime is not “Abuse by men, but abuse of men”, it’s the absence of male rights and not due to male privilege that a few men are found committing crime. Worst, is the snowballing effect, fueled by misandry, wherein even the slightest allegation against a man by a woman lands up the man in deep trouble.

This mindset also leads to promulgation of crime as many a men might just think, “I am anyways going to be framed as a criminal on mere allegations, why not commit the crime as well?” and this was exactly what Amit Buddiraja and Satish Gupta of Infosys did, or what Pavan Kumar of Kakkardooma or Pradip Jain of Deoli did. All these men were being harassed by their wives with either a threat of a false dowry case or an actually filed false case of dowry and being exasperated they took law into their hands and killed their wives. Except for Satish, all the other three committed suicide after that.

These and many other such examples clearly show the promulgation of crime in the society. None of these men were professional criminals, yet, what forced them to commit a crime? It was the criminal anti-male mindset of the society that holds a man accountable till he does not come out clean. One false allegation and the life of the man is hung at gallows.

Also, for those men, who commit crime, are they born criminals? They aren’t, but since our society forces every boy to earn his manhood socially and not gain it biologically, unlike girls, who beget their womanhood biologically; such a double standard mindset creates a fear psychosis inside men which makes them very weak emotionally.

At the same time, a strong social urge for the boy to be a strong protector, the man is torn inside out, trying to deal with a weak, disfigured and distorted emotional state of mind coupled with a requirement to be strong physically.

Ultimately, any attempt to abuse the man emotionally shall be met with a violent reaction and then we say, men are criminals and they commit crime forgetting the fact that, “the society creates the crime, the man merely commits it”.

Should we want crime to reduce, then instead of punishing men, we must stop creating crimes, we must stop abusing men and we must stop forcing boys to earn manhood. Respect must not be a scarce resource in the male world achievable only through social achievements, most of which mandate a man to view every other man as his enemy and practice misandry (hatred against other men).

Male Hatred (misandry) is extremely dangerous to society and will never allow crime to vanish. Choice belies with the society – whether it wants to continue with male hatred and allow crime to go unperturbed or take steps in the direction of male welfare so that crime reduces.

We had a very good event yesterday. Around 110 SIF members joined the march. Around 25-30 people from the neighbourhood came.

We started the march from the victim Manoj Kumar’s brother’s residence. As soon as we started assembling, immediately two TATA SUMOs came there tagged with “Election Duty”. The Vigilance Department of Election Commission had come to inquire what was going on as polls are announced in Karnataka and election code of conduct is ON. They were given proper anti-misandry antidote and sensitization about abuse of men and misuse of laws.

They left the place smiling and told us not to make noise or break the discipline. They were handed over a copy of the press release.

After that, we waited for some more time, and then started forming the queue with 2 people in a line. A banner made by Marital Justice group, printed by us on a size of 4′X2′ was held by both the brothers in the front who led the march.

The photos of Manoj Kumar and Dr. Prashant Pandey from Dehradoon who also committed suicide due to legal terrorism about 55 days ago and still his perpetrators are roaming large. I told the Vigilance Department that you will not face such issues if the police stops giving lipservice to men and actually works for them (as they belong to the Police Dept., news will spread inside).

Around 7, we started after I briefed the crowd about the route and the walking rules. We started a slow march with candles burning, and posters, placards and banner shining. We were initially 44 people in 22 lines. But as soon as we reached the first junction out of the lane, lot of people joined us – mainly SIFF members and some bystanders, who came after reading the banner.

Near the first crossroad opposite Mast Kalanadar, 4th Block, TV9, News9 and Suvarna TV came and recorded. Victim’s brother spoke about the abuse their family went through and Kumar Jahgirdar spoke about so many men committing suicides and it being a social serious which is neglected.

After that we moved on. As we reached the first traffic junction – now we supposed to get onto the main road that goes straight towards Sony Junction away from Wipro Park – the traffic constable who were with us, told us to move quickly. But the grief stricken people moved slowly and the traffic was blocked for some time.

The expression on the face of the onlookers changed drastically from anger to disbelief, shock, dismissal, worry as they saw the banner. They were angry on face as we blocked them but when they saw the banner, they had no words.

As we continued to move amidst heavy Koramangala Saturday Evening traffic near Sony World, many so-called good and law abiding citizens of India saw the effect of law misuse and abuse on men. We distributed around 100 press releases to the onlookers so that the message spreads.

I could see many people peeping from the food joints in and around Sony World. From Sony world signal towards NGV, we walked all the more slowly and stopped a lot wherever there were more than 2-3 people standing and ensured they at least read the banner. Some people followed our procession in their cars, till they found a parking slot, parked the car and joined us. One such fellow who joined us, was around 45 and looked pretty trendy in appearance and asked us about the agenda.

When we told about the abuse of men and misuse of law, he agreed and he said, “Men are being used as FREE ATM MACHINES”. Then two more lads of about 21-22 joined us. We briefed about abuse of men and false cases. They added, “We fear false rape case”. Then one fellow asked them, “Are you married”, at this, the stylish 45 year old fellow retorted saying, “Do not ask them if they are married or not, ask if they are suffering or not.”

We then proceeded and reached Koramangala PS. We all gheraoed the SHO there. He was aware of the procession and knew we were coming. We all went inside the premises and gathered at the entrance of the PS. First the brother of the victim explained all the ordeals they went through and how police’s indifference has hurt them.

It seems Manoj went to HAL PS to file a complaint against his wife and he was ridiculed. This was also told. After Manoj, me, CS, Rukma and Raju briefed the SHO in turns about the men’s rights movement, abuse of men and misuse of laws. The discussions continued for about an hour before the crowd dispersed. We placed all the candles in front of the PS. Put both the photos and banners there too for some time.

All in all, it was a good event. One of my colleagues had come with his wife. While talking there, his wife told me that her mama faced 498A way back in 1993 and went bankrupt in fighting and settling the case. She still carries the stigma and she appeared very happy that a movement like this exists. She had just landed from a flight from Lucknow to Bangalore and came directly from airport along with her hubby – my colleague.

I feel extremely satisfied as I write this narrative.

Morning Shocker:

It was a usual Wednesday morning to which Bangalore woke up, only to be shaken by the brazen news of a young man of 36 committing suicide due to alleged torture by wife leaving behind his 1 year old son, 2 married brothers, an old mother and an unfortunate suicide note blaming his wife and mother-in-law for the extreme step of ending his life. Techie by Profession, Manoj Kumar worked for Oracle, while his wife Pramila worked for Bharat Electric Limited.

Manoj has had a tumultuous marriage. Constant torture by his wife which reached unbearable limits as she forced him to stay away from his family under threats of getting him jailed under a false 498A (dowry) case led Manoj to write “Sorry Son” on his T-Shirt before hanging his body from the ceiling fan on the unfortunate night of 8th April 2013. This was after his wife abused his entire family, physically assaulted his brother with a helmet and tried to attack his old mother before she dared them that she would get them jailed in false dowry case if her demands are not met.

Manoj is not a solo victim but amongst lakhs of men who are abused daily in marriages and with this suicide, he enters the thousands of unfortunate men who die a silent death in an insensitive society that refuses to protect men.

Far Away in Dehradoon:

Manoj’s case is not very different from the case of Dr. Prashant Pandey of Dehradoon who committed suicide about two months ago as he was trapped in false cases and was not getting justice anywhere from the legal system. 55 days after he succumbed to the anti-male bias, his perpetrators roam free in the society while the Dehradoon DCP gives lip-service to his family.

Save Indian Family Foundation (SIFF) is a non-funded non-profit NGO fighting for men’s rights, Gender Equality and Family Harmony by creating awareness against the misuse of anti-male laws like Section 498A (the dowry law), the Domestic Violence Act, and the various Maintenance laws etc. which are systematically breaking down the family system of India and perpetrating state sponsored abuse against men.

SIFF recognizes such abuse of men is growing by the second and being exasperated, these men are committing suicides. These men are not dying; they are actually “Martyrs of Marriage”, as they lay down their lives at the altar of marriage trying to protect it from their vindictive, abusive, manipulative and greedy wives.

Having no law at their disposal to protect them and also fearing false cases being lodged against them under the various anti-male laws, these innocent abused male victims feel it’s the end of the road and take to the extreme step of ending their lives. SIFF displays solidarity with the families of such victims and strongly condemns their deaths.

No Isolated Cases:

As per data provided by the National Crime Record Bureau (NCRB), every year more than 62000 married men are committing suicides and the number is rising. In the last 15 years close to 200,000 married men have committed suicide directly due to domestic violence and torture from wife as per the analysis of NCRB, a unit of Union Home Ministry.

A mark of respect for the Martyrs of Marriage:

On the Saturday, 13th April, 2013, four cities – Bangalore, Delhi, Lucknow and Kolkata – will rise for men as citizens will be participating in Peaceful Candle March praying for the departed souls of the Martyrs of Marriage demanding strict action against such women and their family members who abet the suicides of these martyrs.

Similar marches shall also be held in Hyderabad and Pune on Sunday and in London as well.

The Address for Bangalore march will be

#931 1st B Main, 4th Block, S T Bed, Koramangala. 2nd Left after taking left turn near Mast Kalandar near Sony World, Koramangala.

Time: 7: 00 PM, Date: 13 April 2013

SIFF Demands:

Bail must not be granted to Manoj Kumar’s wife Pramila

Her mother must also be arrested and sent to jail as she has been named in the suicide note.

Police must immediately arrest all the accused named in the suicide note who abet the suicide of a man, especially married men.

Such cases should be tried in fast track courts so that the bereaved can be delivered justice at the earliest.

Government must enact a special law to protect men from the terror they face in intimate relationships – marriage being one of them.

Government must conduct studies and surveys targeted to study the abuse faced by men.

Government must form National Commission for Men.

Government must form Men’s Welfare Ministry.

Government must allocate budget in the Union budget for causes specifically targeted towards welfare of men.

Government must stop misuse of gender biased laws like dowry law, domestic violence act, etc.

Candle light march in Bangalore being organized by Save Indian Family Foundation as a mark of respect for the martyrs of marriage.

Surprised by the term “martyr”?

These men who commit suicide due to torture by wife and legal system are not dying; they are actually “Martyrs of Marriage”, as they lay down their lives at the altar of marriage trying to protect it from their vindictive, abusive, manipulative and greedy wives.

Details of the event are available at

Candle March in memory of Martyr of Marriage Manojkumar of Bangalore

If you are in and around Bangalore, mark your respect for the martyr by attending the event.

At the outset I was not able to believe my eyes when I read the editorial piece ‘India’s Novartis Decision’ in The Newyork Times dated April 4 about the recent Novartis decision by India’s Supreme Court and the subsequent lauding of the judgment and its paramount significance as given in the editorial.

As a brief background, it would be pertinent to mention here that Novartis, a company that manufactures cancer drug called Gleevec, imatinib. Novartis filed a patent in India with a different form of the same drug claiming better absorption capabilities and better bonding with blood. However, the patent was rejected and the matter went all the way to the Honorable Supreme Court that was supposed to decide on the constitutional validity of Section 3(d) of the Patents (Amendment) Act 2005.

Section 3(d) provides for safeguards against obtaining patents for the same type of substance in different forms. Upholding the sanctity of the said section the Supreme Court ruled that Novartis has failed to provide substantial data to show “efficacy” of the drug as mandated by Section 3(d).

The decision by the Supreme Court is a far-reaching one as it provides relief to a large number of poor people in India because if the patent was allowed the drug price would have shot up by at least 12 times making it Rs. 1,20,000 per month making it next to impossible for the poor to afford cancer medicine. Also, India being the largest supplier of generic drugs, and Gleevec being a generic drug, this decision of the Supreme Court of India has global implications.

As long as the story ends here, all’s well because this decision showcases extreme amount of capability in the Indian Judiciary to deal with sensitive issues and to go into depths about chemical nature of drugs and the overall efficacy improvement provided between versions and to chart out a verdict that protects the poor and affects the global generic drugs market.

However, applause takes a backseat when one looks at the performance of the judiciary in matrimonial matters. Without going into too much details, I will just list down some of the important statements/observations made by the great Indian Judiciary, especially the Supreme Court judges in matrimonial matters and in cases filed by women,

1. Do as your wife says. If your wife says “Look Left, then Look Left”, if she says, “Look Right, then Look Right” while rejecting divorce filed by a man.

2. Beg borrow or steal but maintain your wife – to an unemployed man.

3. Even if it was proved that the wife had falsely implicated the husband and his family in dowry case, the Supreme Court ordered the husband to pay Rs. 50 lakhs as alimony to wife.

4. The Mumbai High Court dismissed the divorce case of a man after 17 years of struggle, citing that daily quarrels by wife do not tantamount to cruelty.

5. When a man approached the Gujarat High Court challenging the misuse of Dowry laws, instead of hearing his pleas, the court ordered him to pay Rs. 1 lakh as fine to a woman organization.

6. In a rape case, the Supreme Court observed that mere statement by a woman that she is raped is enough, there is no need for medical examination if the woman does not want a test to be conducted.

These and many other such related incidents in matrimonial cases have left men high and dry. And it is extremely painful to see that the same judiciary that showcases the high brilliance of capabilities in other general matters displays such lack of common sense and an extreme sense of bias and hatred against men.

In fact, it’s not the lack of common sense but more of a sense of male hatred that makes the judiciary give such statements. These statements have very adverse effect on men who are fast losing the trust and faith on the judiciary and taking law into their hands.

Whether it is Amit Buddhiraja or Satheesh Gupta from Bangalore who killed their wives after the men were threatened of false dowry cases, or Pradeep Jain from Deoli who killed his wife and in-laws as they were torturing him and not allowing him to meet his sons or Pawan Kumar of Delhi who shot his wife at Kakkardooma Metro Station, all these incidents have one thing in common.

They were harassed and tortured by their wives and seeing the state of the Indian judiciary they had no hope whatsoever in the judiciary that they would even get a semblance of an iota of justice and hence exasperated, they took law into their own hands, and barring Satheesh Gupta, all the other 3 men committed suicide after killing their wives.

If the judiciary is not more proactive, and continues with the male hatred unabated, then more and more such crimes will take place in the society when the common man, an otherwise a non-criminal, will take the law into his hands and for that, the Indian judiciary would be responsible.

Much ado about nothing. These are the only four words that one can possibly think of to describe what is occupying the media when it comes to the verdict passed by the Honorable Supreme Court on the 21 March 2013, upholding the conviction of Bollywood actor Sanjay Dutt.

Whether it is news articles, opinions, newspaper columns, online articles, TV debates, citizen journalism , or the pardoning petitions being filed, all are revolving around the question – “Should Sanjay Dutt be pardoned?” However, I have pre-question to that – “Why should we even think of pardoning Sanjay Dutt?”

Is it not enough that he was given a fair trial, evidence was found against him and the court convicted him and his appeals went all the way to the Supreme Court which also upheld his conviction? Now, after the trial and the verdict being upheld by the highest court of India, if we talk of pardoning such a criminal, then why do we have the judicial system in India in the first place, wasting billions of rupees of the public exchequer?

Can’t we have a system wherein a person is punished based on his/her popularity and on factors as to whether he/she is a good family person or not, a good father/mother, husband/wife and carries a reputation or not. Worst, let every person have his own fan club and the strength and influence of the fan club will decide whether a person should ultimately be punished for crimes committed and proven beyond doubt or not?

Does my proposal sound ridiculously stupid? Well, that’s exactly the kind of feeling that one gets as we witness the drama that unfolds in the society around Dutt’s conviction. The whole issue of pardoning a hardened criminal like Dutt and setting aside his conviction despite evidences being found against him and various eminent personalities like ex-Judge Markandey Katju, Congress spokesperson Manish Tewari, MP Jaya Bachchan and many others in the brigade sound extremely ridiculously stupid.

And it is disheartening to see that a society comprising otherwise intellectual individuals witnesses it dumbfounded and only talks about criticizing the campaign-de-pardon of Sanju Baba (as he is fondly called) at coffee tables and tea joints.

As if ridiculous stupidity had its limits, the arguments being given in favor of the pardon are laughable at best and despicable at worst.

1. If Dutt was an innocent kid at the age of 33, when he committed those crimes, then why do we have 18 years as juvenile age limit? Why not 34?

2. If Dutt has a family to support, then all such convicts who have family must be granted pardon, why double standards?

3. If his sister and Congress MP, Priya Dutt can talk of having harsh anti-male laws to incarcerate innocent men as under-trials, merely because a woman complains against those men, then why not her thrice convicted brother?

4. If we can even consider the fact that whether we can pardon Dutt or not even after he is convicted thrice, then why don’t we first acquit all such men who are still trapped in false and vexatious matrimonial litigations filed by greedy and manipulative wives without trial or evidence?

5. What type of example are we trying to set here by wasting our time debating whether we should pardon a thrice convicted criminal found guilty of offence corroborated by clinching evidence beyond doubt while the country is losing one innocent married man every 8.5 minutes leaving behind a family to be supported?

6. If Kanhimozhi cannot be even granted bail as an under-trial with the argument that she has a family, why are we using the same argument to pardon a thrice convicted criminal?

7. If ex-judges and sitting ministers talk of pardoning convicted criminals merely because they are popular, why do such judges and ministers have problems when movies expose their misdeeds, ill-conceived conspiracies and scams on the screen?

8. What kind of judicial independence are we talking of and why do we keep on upholding the sanctity of the judicial system of India when journalists, reporters and people with half-baked knowledge of law are shouting about setting aside a judgment passed after due deliberation, weighing of evidence and conducting a fair trial?

9. Why are we so uncomfortable seeing our reel-life heroes as real-life villains and embrace truth?

10. Did we apply the same logic/argument/emotions for other convicts, under-trials and arrested people who are just ordinary citizens, devoid of any fan club, popularity or public fame to back with?

These and many other questions must be answered before we can even think of pardoning Dutt. And till the time we don’t solve these questions, let Dutt go to jail and serve his sentence. Life will be much easier with an example set rather than a debate won.

PRESS RELEASE

Subject: Men’s Rights Activists celebrate conviction of Sanjay Dutt; miffed at talk to pardon him

Organizations fighting for men’s rights, men welfare and abuse of men under anti-male laws like Section 498A, Domestic Violence Act, rape laws, sexual harassment laws, etc., under the umbrella name of Save Indian Family (SIF), are appalled at the generosity being depicted by eminent personalities like retired Justice Markandey Katju, Manish Tewari, etc. in petitioning for pardon to be granted to Sanjay Dutt after the Honorable Supreme Court upheld his conviction.

It is pertinent to mention here that Dutt was found guilty of possessing illegal arms, also had some alleged role in the 1993 Mumbai serial blasts that claimed that lives of 250 people and injured more than 750 people. After years of trials and appeals, the Honorable Supreme Court finally upheld the conviction of Sanjay Dutt establishing him as a criminal and sentencing him to 5 years of Rigorous Imprisonment. Since he has already spent 18 months in jail, he would be required to spend the balance 3.5 years behind jail.

However, as soon as the sentence was upheld, we witnessed a melee of sympathy and brouhaha of emotions and suddenly we saw eminent personalities and renowned actors of Bollywood jumping in to “save” Dutt from the punishment accorded to him for the crimes that he committed.

And just before we react to that, here are some imminent questions that need immediate and satisfactory answers:

How just it is for the Govt. to let go a criminal convicted in a very serious case, while it does nothing for lakhs of innocent men, women and children jailed in false cases under section 498A (Dowry Law)?

How often did Sanjay Dutt, his politician sister Priya Dutt or Bollywood speak about ending jailing of innocent people in India under 498A?

Six young boys spent 18 months in jail in Pune in TISS False rape case. What did Sanjay Dutt, Priya Dutt (MP) and Bollywood do for such innocent young boys implicated in false cases?

Why do innocents go to jail and convicted criminals get mercy and pardon?

Why people are talking about Sanjay Dutt’s work and his family background, while people and media never look at families of those innocents accused falsely under Section 498A?

Why do innocent and ordinary citizens have to hide like criminals, while convicted criminals like Sanjay Dutt roam freely?

DMK MP Kanimozhi was jailed in Tihar Jail for 6 months. If people claim Sanjay Dutt is just stupid and he not a professional criminal and his parents did a lot for the country, then the same could have ben said for Kanimozhi as well. She also has a family and a son. Her father and her family have also done a lot for Indian people.

Why does the society not think of amending Section 498A which has been responsible for jailing of lakhs of innocent men and their families while it is ready to pardon a convicted criminal, accused of gross crimes against humanity?

On one hand, Aamir Khan of Bollywood spread lies on national television that men are waging a war against women, and on the other hand, for Bollywood a person like Sanjay Dutt who joined hands with those who really waged a war against the nation are not criminals? How fair is that?

Is Bollywood turning out to be the Tinsel Town of Hypocrites?

Bollywood itself promotes so much of male hatred and glorifies the violent protector role in men; its actors have no locus standi whatsoever to talk about men, either innocent or convicted criminals. Hindi movies portray show much of violence against men, especially when the hero fights the so-called baddies. The gruesome nature of violence that is showcased on the screen, wherein the hero throws around other men like objects, creates a very bad impression on the society. It makes the society insensitive to violence against men and abuse of men.

As a result, men find no communicational space in the society and most of them end up committing suicide being exasperated and frustrated by the constant indifference and judgmental attitudes of a society that is largely influenced by the Bollywood.

Bollywood glorifies anti-male concepts like the violent protector role of men, men judging each other, men discriminating against each other, men ruining their lives behind grudge-intensive-revenges, men feeling not-man-enough for failing to protect their family and thus Bollywood contributes to a very large extent for creating anti-male atmosphere in the society which ultimately kills men. Every year 80000 men commit suicide compared to 40000 women. Will Bollywood take the responsibility for that?

Bollywood actors like those of Farhan Akhtar indulge in spreading misandry (social hatred against men). Farhan started a campaign under the title of “Men Against Rape and Discrimination (MARD)” and then, started spreading anti-male sexist language which meant that a man is a man enough only when a woman certifies him to be so.

Why doesn’t such sexist language exist for women?

How often is a woman asked to prove her womanhood by sacrificing her own likes, interests and aspirations?

Why are such partisan double standards, inherently gender biased and anti-male in nature, are glorified as much needed social movements and social transformations?

Why are men forced to such judgmental attitudes in this age of so-called gender equality?

Why are innocent men forced to go through arduous legal trials merely because a woman complains against them?

Sanjay Dutt’s own sister Priya Dutt, who also happens to be a Congress MP, who was very vocal on the TV about having draconian anti-male laws that would facilitate a man’s arrest merely on a woman’s complaint without trial or investigation, is now scouring for support for her convicted criminal brother, who enjoyed celebrated immunity all these years and has been found guilty all the way to the Supreme Court!

Men’s Rights Organizations are very happy that an anti-male MP got her own bad karma back and are celebrating the conviction of her criminal brother.

We Demand:

The Conviction order of the Honorable Supreme Court must be upheld and Sanjay Dutt must be immediately sent to jail to serve the rest of the term.
