Wake up Judiciary!

Yesterday, i.e. 30th October 2009 I was witness to the launch function of India’s first ever magazine on legal and corporate affairs, “LEX WITNESS” in Bangalore. The function was presided over by Dr. Justice V S Malimath, Chairman of Law Commission of Karnataka as the Chief Guest and Justice V Gopala Gowda, sitting judge of the High Court of Karnataka and Executive Chairman, Karnataka State Legal Services Authority, as Guest of Honor.

It was a very brief function wherein Justice Malimath laid down some benign guidelines for a proper functioning of the magazine as the media and then Justice Gowda gave his thoughts which were really interesting.

Often it happens that when there are inherent insecurities and fears stacked up they come up unasked for and at uncalled for occasions. Something similar happened with Justice Gowda, who came up with concerns like,

  1. The judiciary is overburdened.
  2. The judiciary should be independent,
  3. The judiciary has to protect women.

Sub: SIFF presents Research Report on 498A and Alimony/Maintenance to Law Commission of Karnataka

Save Indian Family Foundation (SIFF) is a non-funded non-profit NGO fighting for men’s rights, Gender Equality and Family Harmony by creating awareness against the misuse of gender obsessed laws like Section 498A, the Domestic Violence Act, and the various Maintenance laws etc. which are systematically breaking down the family system of India.

Gender-budgeting has been happening in India since quite some years and with the institution of Constitutional and quasi-constitutional bodies like the National Commission for Women (NCW) and Women & Child Development Ministry (WCD), a significant portion of the union budget is kept aside for studying women’s issues and addressing them through recommendations provided by NCW to WCD.

Interestingly, in the last 62 years of Indian Independence neither a single rupee has ever been allocated for men’s welfare nor has a single Constitutional/Academic body ever been formed to study the problems faced by men let alone addressing them.

Section 498A causes 4500 crore losses annually

Approximately 4500 crores are lost every year due to arrests in dowry harassment cases. Most of the filed cases turn out false later. If false cases are prevented than this loss can also be prevented. This has come out due to a research report by Save Indian Family Foundation (SIFF). This report has been prepared on the request of the Law Commission of Karnataka and is a result of extensive research. A copy of the report has also been sent to the Law
Commission of India and the Ministry of Law and Justice.

Reading the article “Good or Bad, Hard to Say!” suddenly struck a chord with me regarding the deteriorating status quo of the institution of marriage in India and its fatal repercussions on men. Marriage, at least in India, has always been projected as “Tumultuous for women and blissful for men”. However, perceptions are seldom reality.

This has led to a social meme that when a marriage breaks, it does not affect the man and thus men are offered no protection from failed marriages the way women are offered. However, what a man goes through in a bad marriage can be understood either by the victim himself or men’s rights activists who understand a man’s pain.

Most men in broken marriages sulk in silence; feign a plastic smile to tell everyone, “I am fine.” While many unfortunate ones commit suicide as elucidated from the below 2 articles,

Men’s Rights Activist openly threatened on live TV Show

Below complaint shows the anarchy India is going through currently. If the woman’s organization are so sure about their causes why are they getting insecure about men’s issues being highlighted in the media.
How are abused men threat to the existence of women’s organizations that they have stooped this low to run their “Shops of Women’s Rights?”
Or is it that the wrong representations they make about women’s (read wives’) victimization will be exposed by men’s rights movements and they will stop receiving funds?
Are they more concerned about their funds than social issues?

I am the President of All India Forgotten Women (Regd.). Our organization is observing October as “Domestic Violence Awareness Month”. As part of this campaign, we launched two organizations – 1) All India Men’s Welfare Association and 2) Andhra Pradesh Mothers-in-law Protection Association. The news about the launch of Andhra Pradesh Mothers-in-law Protection Association has been covered widely by the print media as well as several TV Channels. TV5 invited me for a live show “Snehita” today, 21 October 2009, between 2:15 to 3:00 pm. One of the callers, seemingly a follower of V. Sandhya, President of POW, abused me over the phone for launching the organization and for debating on TV with V. Sandhya. She also threatened me to close the organization.
I fear danger to my life and limb from V. Sandhya’s followers, and I request you to please provide me protection. I also request you to please investigate into the matter, and take appropriate action against the offenders. The origin of the
call, phone number of the caller and recording of the show should be available
with TV5. I would also like to state that should any harm occur to my life or limb the above mentioned followers of Sandya should be held responsible for it.

Press release: Urgent need to replace PWDVA and such laws with gender neutral laws

What are the problems with PWDVA and similar gender-biased laws?

The PWDVA (Protection of Women against Domestic Violence Act) was passed by legislature and came into force on 26th Oct 2006. While the name of the Act itself suggests noble intentions like protection and welfare of women, the act itself is hardly helpful to needy women. On the other hand there is plenty of evidence that it is being misused by unscrupulous women, which has led to complete hijack of the Indian Family System by external vested interests.

No data has ever been provided to justify unconstitutional laws like the Domestic Violence Act and the cruel and unusual procedures therein. On what basis, has the Domestic Violence Act neglected,

  1. Domestic Violence against children.
  2. Domestic Violence against elders in the family.
  3. Domestic Violence against male members in the family.
  4. Domestic Violence initiated by female members,

NCW is a fabulous organization

Very recently the National Commission for Women (NCW), proposed revolutionary recommendations in Section 125 CrPC which deals with maintenance to children, parents and spouse by men. Without going into details, I will cut the crap short by highlighting the gist of the recommended amendments,

A man cannot deny maintenance citing insufficient funds as the reason even if he has to maintain an adulterous wife. It is the duty of a man to maintain his wife irrespective of sufficient means.

Immediately seeing the recommendations, I felt that if we extend the arguments to other areas of life, so many problems can be solved, for e.g.

  1. An email can no longer cite “insufficient bandwidth” as a reason to arrive late in your inbox. It is the duty of an email to reach an inbox irrespective of sufficient bandwidth.
  2. An employer can no longer cite “insufficient funds” as a reason for not giving hike. It is the duty of every employer to give hike to their employees of irrespective of sufficient funds.
  3. Government can no longer cite “insufficient funds” as a reason for not laying down roads. It is the duty of every Govt. to lay down roads irrespective of sufficient means.
  4. A mobile operator can no longer cite “insufficient network” as a reason for not being able to connect mobiles. It is the duty of every mobile provider to connect mobiles irrespective of sufficient network.

No Arrest in dowry harassment matters!

  • Law commission gave report to home minister
  • No need to review the provisions of stay

The path is clear for the implementation of Cr.P.C. amendments that have mandated no arrest of the accused in cases leading to less than 7 years of imprisonment. Law commission, along with tightening the grip on police officials, has recommended the continual of recent amendements. The commission said it is un-necessary to ponder on the other section – 309. Staying the proceedings or not is a matter of court’s jurisprudence.

Mothers-in-law in our country are being severely discriminated against, neglected and subjected to all forms of domestic abuse over the last decade. Unless provisions are made to protect mothers-in-law from discrimination, domestic violence, and legal harassment, and unless steps are taken to ensure their welfare during their post-menopausal years, we will witness serious deterioration in the health conditions of aging women in the country, and reduction in their life span.

Andhra Pradesh Mothers-in-law Protection Association (APMPA) is the first ever social forum created to protect the rights and interests of mothers-in-law in Andhra Pradesh. APMPA is the Andhra Pradesh chapter of All India Mothers-in-law Protection Forum (http://www.aimpf.org) which was launched on 6 September 2009 in Bangalore, followed by the launch of local chapters in Delhi, Nagpur and Lucknow.

Mothers-in-law have historically been portrayed as evil and bloodthirsty by media and popular culture. However, it is a scientifically and also statistically established fact that mothers-in-law are unnecessarily maligned and subjected to discrimination by the society.
