Press Release

DOMESTIC VIOLENCE AWARENESS MONTH – INDIA – 2009

October is “Domestic Violence Awareness Month”. India is observing “Domestic Violence Awareness Month” for the first time this year to make it an International event for all men’s rights and fathers’ rights groups across the world.

Four organizations in Hyderabad viz. Save Indian Family Foundation, All India Forgotten Women, Rishtey and Children’s Rights Initiative for Shared Parenting, are launching this campaign on 2 October because it is the International Day of Non-Violence, an occasion meant for disseminating the message of non-violence through education and public awareness.

Beginning today, our month-long campaign will focus on educating the Indian public about how the problem of domestic violence has, for decades, been misrepresented, how domestic violence has been commercialized, and how Indian laws claiming to prevent domestic violence are actually promoting domestic violence and human rights abuses against men, women and children. We will also urge lawmakers and the Government to make appropriate reforms in laws and policies and make gender neutral provisions to end domestic violence against men, women and children.

PRESS CONFERENCE

To mark the beginning of DOMESTIC VIOLENCE AWARENESS MONTH

On 2 October 2009 2:00 p.m. at Basheerbagh Press Club

  • Indian laws against domestic violence presume that the accused is guilty until proven innocent and violate universal principles of fair trial.
  • Every year, over 1 lakh innocent persons (one innocent person every 5 minutes) are arrested under IPC Section 498A including 4,000 innocent senior citizens (one innocent elderly person every 2.5 hours) and 350 children (one child per day) without evidence or investigation.
  • Indian laws against domestic violence blatantly deny protection to men against any form of domestic abuse, and every year, over 56,000 married men commit suicide due to verbal, emotional, economic and physical abuse and legal harassment.
  • In the last four years alone, over 1,23,497 women have been arrested under IPC Section 498A alone, without evidence or investigation, not for committing any crime under law, but only because they were related to a man.
  • Have we gone too far with our “get-tough-on-crime” approach to curbing domestic violence?
  • Have we become irrational in our approach to women’s empowerment and women’s rights?
  • Are fundamental Constitutional rights being set aside?
  • Are we now supporting violation of human rights of innocent men, women and children?

Violence against Men – the Untold Truth

Posted in Men, Women, dowry, government, legal extortion, legal terrorism, life, marriage, society tagged , , , , , , , , , , , , , , , at 12:33 am by legalfighter

In continuation with my article, “Violence against Women – A perception or a Reality” this article covers the topic of Violence against Men extensively as we head into October – The Domestic Violence Awareness Month. As explained in the prequel, there are principally four categories of violence, viz.

  1. Female to Male Violence.
  2. Female to Female Violence
  3. Male to Male Violence
  4. Male to Female Violence.

As already explained in the prequel, the society refuses to accept Female to Male violence and considers Male to Male violence as entertainment. And there lies the crux of this article. Because of over-hyped and often unnecessary feminist propaganda about Domestic Violence one always thinks about Violence against Women (VAW) as the only form of prevalent violence; however, that is not the topic of this article.

To,

The Honorable Minister for Law and Justice

Dr M Veerappa Moily,

Sub: – Paying maintenance to qualified and empowered women for short marriages must be stopped with immediate effect.

Honorable Minister,

Ordering maintenance to a qualified woman voluntarily incapacitating herself after a short marriage just to extract money from her husband is nothing but a judicially imposed system of involuntary servitude wherein one human being is placed within the bondage to another one as long as the maintenance term is ordered. I feel that it is every husband’s responsibility to provide for child support however paying maintenance to qualified women in childless marriages who voluntarily incapacitate themselves must be stopped outright.

Divorce cases should be disposed of in a year: Moily

Law minister proposes: Amendment in law to make divorce cases time-bound

Bangalore: The 3,000-odd couples who file for divorce in Bangalore every year may soon heave a sigh of relief. The endless wait these couples bear before a divorce decree, or for a decision in a child custody battle, may be soon cut short. Union law minister M Veerappa Moily has mooted a proposal to set up more family courts to ensure speedy disposal of matrimonial cases.
Moily said that the government may even consider an amendment in the law to make disposal of divorce and custody cases time-bound. He said that family courts will be given a target of winding up such cases within a year of being filed. The minister believes that litigating couples should be freed fast from a broken marriage.
“There is no need for divorce cases to drag on for years when the marriage has actually broken down. Similarly, the children’s custody cases must be decided in a time-bound manner so that there is no uncertainty over their future,” Moily said.
It is estimated that on an average 3,000 cases of divorce are filed in Bangalore, 7,500 in Mumbai and 9,000 in Delhi every year. In fact, the Chief Justice of India had recently said that family and matrimonial disputes are responsible for adding the burden of backlog of cases in courts.
The Law Commission has recently suggested making “irretrievably broken down marriage” a ground for divorce. However, Moily said that all effort should be first made to save a marriage.
“Typically, disposal of a divorce case takes seven to nine years. However, we have seen cases where judges have rejected divorce after 14, 15 or 17 years. This is unacceptable. Judges have no right to deny a peaceful life to litigants,” said Virag Dhulia of Save India Family Foundation (SIFF).

Violence Against Women – A perception or a reality?

Posted in Men, Women, life, philosophy, psychology, society tagged , , , , , , at 12:14 am by legalfighter

Violence Against Women (VAW)” referred to as VAW herein is a very commonly heard and most unchallenged social meme. Such high is its acceptance in society that we have 15 laws to protect women. The Government also spends Rs. 1200 crores annually to stop the violence.  Most of the laws framed to prevent VAW are based on oral evidence of women. Which means only allegations are enough to punish the man – and ends of justice would be met?

There are some primary reasons for this:

  1. Over sensitization of VAW in the media.
  2. A belief that no woman will lie unless severely abused.
  3. The fact that men are, in general, physically stronger than women.

But the foremost fact that VAW is accepted by the society is because society wants to accept VAW. And when the society accepts VAW, it also accepts “Violence from Men” referred to as VFM henceforth.

Open letter to PM for selection of new NCW Chief

Posted in Men, dowry, government, legal extortion, legal terrorism, life, marriage, society tagged , , , , , , , , , , , , , , , , , , , , at 6:16 pm by legalfighter

To
Honorable Prime Minister of India
Dr. Manmohan Singh

Sub: Recommendations on choosing the new chairperson for the National Commission for Women

Honorable Sir,

The primary reason that can be attributed to the phenomenal destruction of the Indian family system in the last 6 years or so it is the militant feminists that have been at the helm at the National Commission for women and the WCD ministry. These women themselves are mostly divorced or spinsters and have never experienced the happiness of a joint family system and as a result do not feel the need for other people to experience the same.

The NCW and WCD ministry has not only on, many occasions quoted false and misleading statistics with no basis for support, but have also never strongly condemned or lobbied for the change of the Draconian and senseless laws IPC section 498A or the Domestic violence act. Instead they have promoted the misuse and when the pressure on them from suffering Indian population was too much for them to bear; they just paid lip service by issuing statements like “60 % of women misuse 498A due to ignorance”. These militant feminists are the sole cause for the 40% divorce rate in Indian cities and the bastardization of the Indian children. These feminists connive with the western aid agencies and want to destroy the closely knit Indian family system and make India a land of divorcees just like the west. With the old NCW chief currently being elected to the parliament there is a need to appoint a new full time chief.

The Alpha Male Dominated Society

Posted in Men, Women, dowry, government, legal extortion, legal terrorism, life, marriage, society tagged , , , , , , , , , , at 11:15 pm by legalfighter

Male Dominated Society! It’s a man’s world! These are the phrases one often hears. They are often used to boost the ego of males that it is your world and you rule the world. But is that the reality or it is only a perception? The same phrases are also used to deny any protection to men, recognize their rights and castrate men emotionally.

But then we do have more men at top, more men running successful business houses, more men in the Government, more men in the bureaucracy, etc. A quick view will always give an impression that men are running the show if we keep looking at only the top. However, a look at the bottom will reveal a completely different picture.

Just the way there are more men at the top occupying top positions, there are more men at the bottom as well. More men commit suicide, more men work for longer hours, more men lose their jobs, more men die younger, more men are killed in road accidents, more men undertake risky and laborious jobs and because of the perception of the so called MALE DOMINATED SOCIETY, these problems of men or men facing these problems are completely ignored or worst, considered as a compensation for men ruling the world.
